Terms and Conditions TAGUS MARINA
1. Use of our website
This website is available to all customers (hereinafter referred to as "USER", or "CUSTOMER", or as "PASSENGER" in case of purchase of services on this website), subject to these general terms and conditions (hereinafter referred to as "Conditions"). When the USER makes a purchase on the TAGUS MARINA website, or uses the website in any way, is accepting these Conditions.
TAGUS MARINA’s website is property of Meridian Season, Lda, located at Rua Comandante Cousteau, 11, 1º Esq. 1990-067 Lisboa, hereinafter referred to as TAGUS MARINA.
The USER declares to be over 18 years of age and have the legal capacity to comply with the terms of this agreement and use the TAGUS MARINA website in accordance with these Terms and Conditions, which the USER declares to understand and accept in its entirety.
The TAGUS MARINA’s website is only for personal use by the USER. Modification, reproduction, duplication, copying, distribution, sale, resale or exploitation of TAGUS MARINA’s website for any commercial or equivalent purpose is strictly prohibited.
The USER agrees not to use the TAGUS MARINA website for illegal or improper purposes. The USER agrees, in particular, that the products or services purchased through this website are intended for use or own consumption, or the use and consumption of people in whose name is legally authorized to act. USER may not resell the products or services purchased through this website to third parties, unless duly contractually authorized by TAGUS MARINA. TAGUS MARINA reserves the right to deny access to this website at any time without prior notice.
2. Services provided by TAGUS MARINA
TAGUS MARINA offers the CUSTOMER or PASSENGER the possibility to enjoy services of stay in the Tagus estuary in fully equipped barges for 2 or 4 people, or to make boat tours in the Tagus estuary, including to the natural reserve areas.
2.1 In the boat tours
Boat tour tickets are sold by TAGUS MARINA or agents for a specific date and time. Promotional vouchers for boat tours that are sold by agents without a specific date and time, require the PASSENGER to book a specific date and time by telephone or through bookings@tagusmarina.com to be used. If the PASSENGER does not show up to embark on the date and time of the ticket purchased or agreed with TAGUS MARINA for the use of the promotional voucher, TAGUS MARINA reserves the right to cancel the purchase made without refund. For this reason, all PASSENGERS must show up at the place of embarkation at least 15 minutes before the departure time.
TAGUS MARINA strongly recommends its boat tours PASSENGERS to adapt their clothes and footwear to the atmospheric conditions and to the ground where the tour will take place.
For safety reasons, all instructions and commands given by TAGUS MARINA crew members, both at the time of embarking and disembarking and on board the boat, must be complied with and respected.
The presentation of the ticket or the promotional voucher by the CUSTOMER (in digital or paper format) is mandatory at the time of embarkation on the boat, if requested by the crew of TAGUS MARINA.
PASSENGERS will embark on a first-come, first-served basis, and there will be no marked places at the time of booking.
Children under 2 years old are not allowed to embark on boat tours. A child or teenager between the ages of 2 and 17 years cannot take part on the boat tour without being accompanied by an adult. To enforce this requirement, each adult can accompany a maximum of four children between the ages of 2 and 12.
Child discount tickets or vouchers are valid for children between the ages of 2 and 12. TAGUS MARINA reserves the right to request proof of age from any PASSENGER to confirm that the ticket purchased is in accordance with PASSENGER’s age. If the legitimacy of the ticket purchased cannot be confirmed, TAGUS MARINA reserves the right to refuse access on board the boat, and there will be no refund of the ticket’s value to the PASSENGER.
TAGUS MARINA reserves the right to refuse access on board the boat to people appearing to be drunk or psychically altered in the opinion of TAGUS MARINA’s crew members, and there will be no refund of the ticket’s value to the PASSENGER.
TAGUS MARINA reserves the right to refuse access on board the boat to any PASSENGER who, at the time of embarkation, is not able to access the boat's interior by his own means under conditions that the TAGUS MARINA’s crew members consider of total security, and there will be no refund of the ticket’s value to the PASSENGER.
The boat has no capacity for carrying luggage or other large objects. These items can be stored at the TAGUS MARINA reception for the duration of the tour, but TAGUS MARINA is not responsible for any damage or theft of those items.
TAGUS MARINA is not responsible for any object left or stolen on the boat, on the facilities of TAGUS MARINA or in the places visited during the tours. However, TAGUS MARINA will take the measures within its reach so that any object found is stored at the reception for a maximum period of 30 days after the usufruct of the service.
TAGUS MARINA will take all measures within its reach so that the boat tours finish at the scheduled time. However, TAGUS MARINA assumes no responsibility for any inconvenience or direct/indirect damage caused to the PASSENGER due to potential delays.
2.2 In the services of stay in fully equipped fluvial barges
TAGUS MARINA will provide the CUSTOMER with an anchored fluvial barge of the typology booked from the date of arrival or, in case the CUSTOMER has not made a booking and contracts the accommodation at the TAGUS MARINA reception, depending on the typology and according to availability, from 2 p.m. on the day of arrival.
Upon arrival at TAGUS MARINA, the CUSTOMER must proceed immediately to the payment of the price due by the barge, number of nights of stay and additional services intended, in the case CUSTOMER has not made the full payment to a booking agent.
Against full payment, TAGUS MARINA will provide the CUSTOMER with a key to access the barge that will remain with the CUSTOMER during the contracted stay period.
On the date of departure, the CUSTOMER will have to leave the barge vacated of people and goods and without any damage until 12 p.m..
If the barge is not vacated until 12 p.m. on the day of departure, it will be possible to accept a late check-out at no additional cost if the capacity of TAGUS MARINA allows it and as long as it does not exceed 2 p.m.. If so is not possible, the late check-out will cost 50% of the cost of the stay between 12 p.m. and 6 p.m. In case we lose a booking because the customer of the following day is unable to check in because the previous CUSTOMER did not vacated the barge on time or the check- out lasts until 6 p.m., the CUSTOMER will have to pay the extra night plus 50% (1.5 nights) as a penalty for damages caused to the image of TAGUS MARINA, having only the right to use the barge in that period if TAGUS MARINA has available barges, otherwise the CUSTOMER will have to pay the compensation and leave the barge as soon as possible.
Pets are allowed in the barges at no additional charge. The CUSTOMER will be responsible for any damage caused by animals without value limits.
Only the people indicated by the CUSTOMER who made the booking at the accommodation check-in will be entitled to use the barge. In case of external visits, the prior communication to TAGUS MARINA is mandatory, and the access to the barge may be refused.
The CUSTOMER must use the barge carefully and with consideration.
The CUSTOMER should treat the other TAGUS MARINA’s CUSTOMERS with consideration and respect the rules of the Marina posted in the place if any, which are also part of the accommodation agreement.
Children and youths under 14 years of age must be supervised by an adult CUSTOMER at all times during their stay on the barge.
The CUSTOMER is strongly recommended not to leave money, jewelry or other valuable items on the barge or in parked vehicles in the surroundings of TAGUS MARINA in his absence.
TAGUS MARINA provides the CUSTOMER with a central safe box in which can be stored valuable objects, as long as they are properly identified in a document for this purpose.
TAGUS MARINA assumes no responsibility for the theft, loss or deterioration of valuable objects such as money, jewelry or other objects of considerable value if such events occur in the barge or in the interior of vehicles parked in the surroundings of TAGUS MARINA.
TAGUS MARINA will only be responsible for CUSTOMER damages or losses when such facts result from the guilty conduct of TAGUS MARINA.
TAGUS MARINA does not assume any responsibility for loss of data provided by the CUSTOMER in case of electronic transmission of payment data, being only responsible in this case if there is guilty action.
TAGUS MARINA assumes no liability for damages or accidents occurring inside the vessels or any part of the Marina unless such accidents are caused by the negligence of TAGUS MARINA.
TAGUS MARINA will not be held responsible to the CUSTOMER in case of delay in the availability of a barge, while there is valid reason for not making it available in a timely manner.
For the purposes of the previous paragraph, will be considered valid reasons to make it impossible or more difficult to make the barge available events such as strikes, blockades, natural disasters, accidents on the barge itself or in the Marina.
In case of delay in the availability of the barge beyond 6 p.m. on the day of the booking, the CUSTOMER can freely terminate the contract without having the right to demand any compensation from TAGUS MARINA in any way whatsoever.
TAGUS MARINA assumes no responsibility for acts committed by any of its employees, unless they are in their normal working hours, duly identified and uniformed as employees of the company.
TAGUS MARINA assumes no responsibility and cannot be liable in any case for non-fulfillment of ancillary obligations.
TAGUS MARINA shall not be liable in any case for any act or omission of any other CUSTOMER, even if it is liable to cause loss or damage to another CUSTOMER. Any damages caused to third parties by barges’ CUSTOMERS shall be the sole responsibility of these and completely alien and unrelated to TAGUS MARINA.
TAGUS MARINA assumes no liability to the CUSTOMER for any loss of profits or indirect damages even if resulting from failure to comply with main obligations.
Services provided on our website
TAGUS MARINA, through its website, provides the USER with the possibility of booking services for full use of anchored barges and boat tours, as well as other specially designed programs in the field of nature tourism in the Tagus estuary.
In this website, we also publish events and festivities that take place in Lisbon throughout the year. In this case, we only disclose its contents and dates, and cannot be associated in any way with the way they take place or with its organization. We are not, for any purpose, representatives of these events.
Insurances
The tours and services offered by TAGUS MARINA are duly covered by insurance policies applicable to Maritime-Touristic activities.
TAGUS MARINA does not offer the travel insurance service, but encourages the CUSTOMER to carry out such insurance policies directly with an insurance company, being that insurance subject to the conditions of the contracted policy.
Acquisition of services on our website
The acquisition of the different services on our website is subject to payment of the value indicated on the website, without adding undeclared amounts. The total value of the service will be clearly stated before clicking the "book" option.
When purchasing services on our website we will ask you for the immediate payment in full. When you rent a fully equipped river barge by clicking on the "non-refundable booking" option you will benefit from a discount on the applicable rate, but you will not be entitled to a refund of the booking amount under any pretext. In bookings for boat tours, there is no refund in cancellations by the CUSTOMER. Only the immediate payment of the requested amounts will guarantee the booking of any service.
In case of opting for the “book” option in the rental of fully equipped river barges, you can cancel your booking up to 48 hours before the date of arrival with full reimbursement of the booking amount. The amount will be credited immediately. If the cancellation is made less than 48 hours before the date of arrival, the reimbursement will depend on the capacity to fill the vacancy with another CUSTOMER.
TAGUS MARINA reserves the right at any time and without prior notice to change the prices of the services, as well as suspend or cancel their sale temporarily or definitively, except for the rights resulting from the purchases already made by the USER.
All services provided by TAGUS MARINA originate the issuance of an invoice that will be delivered to the USER, CUSTOMER or PASSENGER, according to the requested and in accordance to the method of acquisition of the service. In this way, the invoice can be send by email or delivered personally at the time of purchase of the service or at the time of closure of accounts. If for any reason, the USER does not receive the invoice, the USER should contact TAGUS MARINA through info@tagusmarina.com.
The PASSENGER of boat tours is fully responsible for the destination of the ticket(s) or voucher(s), namely for its non-use, loss, theft or destruction, and cannot by virtue of such facts require any compensation or indemnification to TAGUS MARINA.
Payment methods
By purchasing services on our website, the USER can make their payments by credit card. These payments are made in a completely safe manner between the USER and the respective payments platform, and TAGUS MARINA does not have access to details such as card number or others.
By purchasing the services at our direct points of sales, the USER can make payments through debit card, credit card or in cash. The following currencies are accepted with conversion at the day rate: EUR, USD, GBP, CAD, AUD, BRL and CHF.
Fraud in payments
TAGUS MARINA keeps a careful attitude in order to avoid the improper use of forms of payment, common frauds. In this way, TAGUS MARINA may require in some circumstances additional information regarding the form of payment used, namely, among other things, proof of address and copies of identification elements.
Cancellations and refunds
After purchasing a tour or accommodation service, any cancellation that the USER wishes to make is subject to the rules expressed at the time of purchase, as well as the general rules described in these conditions. Any cancellation charges are always dependent on the time you cancel your tour or accommodation service and the specific product you wish to cancel. The best prices always correspond to the strictest cancellation rules, which in many cases can go up to 100% of the amounts paid.
In the specific case of boat tours, in case of cancellation of the tour by TAGUS MARINA for reasons of force majeure, namely those related to weather, atmospheric conditions or sea waves, the CUSTOMER will be contacted by telephone as soon as TAGUS MARINA decides the cancellation of the tour so CUSTOMER can reschedule the tour. In case the CUSTOMER intends to get the refund of the ticket amount, CUSTOMER should inform TAGUS MARINA during the telephone call or by e-mail through bookings@tagusmarina.com.
TAGUS MARINA will expedite the refund with the online booking agent contracted by the CUSTOMER or will return it by bank transfer in case the ticket was purchased directly on the TAGUS MARINA website or in person at the TAGUS MARINA or at one of its agents facilities. The CUSTOMER is responsible for providing an IBAN by e-mail to bookings@tagusmarina.com for TAGUS MARINA to make refunds that may apply.
In the event that TAGUS MARINA is required to make any adjustment to the route initially planned, also due to force majeure issues related to weather, atmospheric conditions, sea waves or others, the ticket value will be refunded in the 50% portion. TAGUS MARINA will proceed to these returns by bank transfer, being the CUSTOMER responsible for providing an IBAN by email through bookings@tagusmarina.com.
In all cases where after a cancellation the USER is entitled to receive part or all of the amounts paid, TAGUS MARINA will proceed to this refund by bank transfer, being the CUSTOMER responsible for providing an IBAN by email to bookings@tagusmarina.com .
Complaints and CUSTOMER support
We can only consider claims for rendered services related to bookings made on our website if presented in writing within a period not exceeding 20 days after the end of the service.

Jurisdiction and applicable law
These "Terms and Conditions", as well as any relationship between TAGUS MARINA and the USER, will be ruled by the laws of Portugal and by the courts of the district of Lisbon. With exception to expressly indicated norms, both parties are subject to the jurisdiction of the Portuguese Courts for any matter resulting from the existence, content and/or interpretation of these general terms and conditions or any relationship between TAGUS MARINA and the USER, with express waiver of the parts to any other jurisdiction.
